These Terms and Conditions govern your use of the website and services provided by Horizon Peak Real Estate, a real estate brokerage operating in accordance with the laws and regulations of the United Arab Emirates, including the rules and guidelines issued by the Dubai Land Department (DLD) and the Real Estate Regulatory Agency (RERA).

By accessing our website or using our services, you agree to comply with these Terms and Conditions.


1. Regulatory Compliance

Horizon Peak Real Estate operates in accordance with:

  • UAE Federal Laws

  • Dubai Land Department (DLD) regulations

  • Real Estate Regulatory Agency (RERA) rules and codes of conduct

All brokerage activities are carried out by licensed real estate professionals holding valid RERA registration cards, where applicable.


2. Scope of Services

Our services may include, but are not limited to:

  • Real estate brokerage (sales and leasing)

  • Residential and commercial property listings

  • Off-plan and secondary market properties

  • Property marketing and client facilitation

  • Real estate consultation and market guidance

All services are subject to applicable UAE laws and RERA regulations.


3. Property Listings & Information Disclaimer

  • Property listings, prices, sizes, availability, floor plans, and descriptions are provided in good faith based on information received from property owners, developers, or authorized sources.

  • Horizon Peak Real Estate does not guarantee the accuracy or completeness of such information.

  • All properties are subject to prior sale, lease, withdrawal, or price change without notice.

  • Images and marketing materials are for illustrative purposes only.


4. No Guarantee or Warranty

Horizon Peak Real Estate does not guarantee:

  • Completion of any transaction

  • Investment returns or capital appreciation

  • Rental yields or occupancy levels

Any projections or market insights shared are indicative only and should not be considered guarantees.


5. No Legal, Financial, or Investment Advice

We do not provide legal, tax, financial, or investment advice.
Clients are strongly advised to consult:

  • Licensed legal advisors

  • Financial consultants

  • Mortgage advisors
    before entering into any property transaction in the UAE.


6. Client Obligations

By using our services, you agree to:

  • Provide accurate and complete information

  • Comply with UAE laws, including AML and KYC requirements

  • Cooperate with documentation and verification processes as required by RERA and relevant authorities

Any misleading or fraudulent activity may result in refusal or termination of service.


7. Fees & Commissions

  • Brokerage fees and commissions are charged in accordance with RERA guidelines unless otherwise agreed in writing.

  • All commissions become payable upon successful execution of a transaction, as per the signed agreement or Form B (where applicable).

  • Government fees, registration charges, trustee fees, and DLD fees are payable by the client unless stated otherwise.


8. Anti-Money Laundering (AML) Compliance

In accordance with UAE AML laws:

  • Clients may be required to submit identification documents and source-of-funds information.

  • Horizon Peak Real Estate reserves the right to refuse or suspend services if AML requirements are not met.


9. Intellectual Property

All website content, including text, logos, images, branding, and marketing materials, is the intellectual property of Horizon Peak Real Estate unless otherwise stated.
Unauthorized use, reproduction, or distribution is prohibited.


10. Third-Party Developers & Owners

Horizon Peak Real Estate acts as an intermediary only and shall not be held responsible for:

  • Acts or omissions of developers, landlords, sellers, or third parties

  • Construction delays, handover timelines, or developer performance

  • Any disputes arising after contract execution between parties


11. Limitation of Liability

To the fullest extent permitted by UAE law, Horizon Peak Real Estate shall not be liable for:

  • Direct or indirect losses

  • Financial or investment losses

  • Delays caused by developers, authorities, or third parties

  • Decisions made by clients based on provided information

All services are provided on an “as is” and “as available” basis.


12. Privacy & Data Protection

Personal data is collected and processed in compliance with:

  • UAE data protection laws

  • Our Privacy Policy

We do not sell or misuse client information and take reasonable measures to protect personal data.


13. Termination of Services

We reserve the right to suspend or terminate services if:

  • These Terms are violated

  • Legal or regulatory requirements demand such action

  • False or misleading information is provided


14. Governing Law & Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the United Arab Emirates.
Any disputes shall fall under the exclusive jurisdiction of the courts of Dubai, unless otherwise required by law.


15. Amendments

Horizon Peak Real Estate reserves the right to amend these Terms and Conditions at any time.
Continued use of our website or services constitutes acceptance of the updated terms.


RERA Form B – Brokerage Agreement Clause

In accordance with the regulations of the Dubai Land Department (DLD) and the Real Estate Regulatory Agency (RERA), Horizon Peak Real Estate acts as a licensed real estate broker representing the client under the terms of RERA Form B (Brokerage Agreement), where applicable.

By engaging the services of Horizon Peak Real Estate, the client acknowledges and agrees that:

  1. Horizon Peak Real Estate is authorized to market, advertise, and promote the property in accordance with the signed Form B agreement.

  2. The brokerage commission shall be payable as agreed in Form B and becomes due upon the successful conclusion of a transaction, including but not limited to sale, lease, or reservation of the property.

  3. Horizon Peak Real Estate acts solely as an intermediary and shall not be held liable for any default, misrepresentation, delay, or non-performance by the seller, buyer, landlord, tenant, developer, or any third party.

  4. All property information provided is based on details supplied by the property owner or authorized parties, and Horizon Peak Real Estate does not guarantee the accuracy or completeness of such information.

  5. Any disputes arising from the brokerage services shall be governed by the laws of the United Arab Emirates and fall under the jurisdiction of the competent courts of Dubai.

Rental-Specific & Ejari Clauses

1. Rental Brokerage Scope

Horizon Peak Real Estate provides rental brokerage services in accordance with RERA regulations and applicable UAE laws. The Company acts solely as an intermediary between landlords and tenants and does not assume the obligations of either party under the tenancy contract.


2. Ejari Registration

  • All tenancy contracts in Dubai must be registered through Ejari, as mandated by the Dubai Land Department (DLD).

  • The tenant is responsible for ensuring timely Ejari registration unless otherwise agreed in writing.

  • Horizon Peak Real Estate may assist with Ejari registration as a facilitation service and shall not be liable for delays, rejections, or errors caused by incomplete or incorrect documentation provided by the landlord or tenant.


3. Commission & Fees

  • Brokerage commission for rental transactions shall be payable as agreed and in accordance with RERA guidelines.

  • Commission becomes due upon signing of the tenancy contract or issuance of Ejari, whichever occurs first, unless otherwise stated in writing.

  • Government fees, Ejari charges, trustee fees, and other related costs are payable by the client unless expressly agreed otherwise.


4. Tenancy Contract Responsibility

  • The terms of the tenancy contract are solely agreed between the landlord and tenant.

  • Horizon Peak Real Estate shall not be responsible for any breach, dispute, default, or termination arising from the tenancy agreement after contract execution.


5. Maintenance & Property Condition

  • Property condition, maintenance responsibilities, and handover status are the sole responsibility of the landlord and tenant as defined in the tenancy contract.

  • Horizon Peak Real Estate does not guarantee property condition, maintenance response times, or service quality after handover.


6. Rental Increases & Renewals

  • Rental increases and renewals are subject to RERA Rental Index guidelines and applicable DLD regulations.

  • Horizon Peak Real Estate may provide guidance based on available RERA data; however, final rental decisions remain between the landlord and tenant.


7. Security Deposit

  • Security deposits are handled directly between the landlord and tenant unless otherwise agreed.

  • Horizon Peak Real Estate is not responsible for the holding, refund, or disputes related to security deposits unless explicitly stated in writing.


8. Dispute Resolution

Any disputes arising from rental agreements or Ejari registration shall be resolved in accordance with UAE laws and, where applicable, through the Dubai Rental Dispute Settlement Centre (RDSC).


9. Limitation of Liability

Horizon Peak Real Estate shall not be liable for:

  • Ejari system delays or government processing times

  • Actions or omissions of landlords, tenants, or third parties

  • Utility connections, service provider issues, or post-handover disputes

Landlord-Only Rental Clauses

Horizon Peak Real Estate


1. Landlord Representation

The Landlord appoints Horizon Peak Real Estate, a RERA-licensed brokerage, as its authorized agent to market and facilitate the leasing of the property in accordance with Dubai Land Department (DLD) and RERA regulations.


2. Authority to Market

The Landlord authorizes Horizon Peak Real Estate to:

  • Advertise the property on approved portals

  • Conduct property viewings

  • Share property information with prospective tenants

  • Negotiate rental terms on the Landlord’s behalf, subject to final approval

All marketing activities shall comply with RERA advertising guidelines.


3. Ownership & Authorization Warranty

The Landlord warrants that:

  • They are the legal owner of the property or duly authorized to lease it

  • All ownership documents provided are valid and accurate

  • No legal restrictions prevent leasing the property

The Landlord shall indemnify Horizon Peak Real Estate against any claims arising from incorrect or misleading ownership information.


4. Rental Price & Terms

The Landlord confirms that:

  • The rental price and payment terms are set by the Landlord

  • Rental increases and renewals shall comply with the RERA Rental Index and applicable laws

  • Final tenancy terms are subject to mutual agreement between the Landlord and Tenant


5. Commission & Payment

  • Brokerage commission shall be payable by the Landlord as agreed and in accordance with RERA guidelines, unless otherwise agreed in writing.

  • Commission becomes due upon signing of the tenancy contract or Ejari registration, whichever occurs first.

  • Commission is non-refundable once a tenant is secured in accordance with agreed terms.


6. Ejari & Documentation

The Landlord agrees to:

  • Provide all documents required for Ejari registration in a timely manner

  • Cooperate with Horizon Peak Real Estate and the Tenant to ensure Ejari compliance

Horizon Peak Real Estate shall not be responsible for delays caused by incomplete or incorrect documentation.


7. Property Condition & Maintenance

  • The Landlord is responsible for delivering the property in a habitable and compliant condition.

  • Maintenance obligations shall be clearly defined in the tenancy contract.

  • Horizon Peak Real Estate bears no responsibility for maintenance, repairs, or property condition after handover.


8. Security Deposit Handling

  • Security deposits shall be received and held by the Landlord unless otherwise agreed in writing.

  • The Landlord is solely responsible for deposit refund and deductions as per the tenancy contract and UAE law.


9. Tenant Default & Eviction

  • Horizon Peak Real Estate shall not be responsible for tenant default, non-payment, or eviction proceedings.

  • Evictions must be carried out strictly in accordance with UAE rental laws and RERA regulations.


10. Limitation of Liability

Horizon Peak Real Estate acts solely as an intermediary and shall not be liable for:

  • Tenant actions or omissions

  • Rental payment disputes

  • Property damage caused by tenants

  • Legal proceedings between Landlord and Tenant


11. Governing Law

These clauses shall be governed by the laws of the United Arab Emirates, with disputes falling under the jurisdiction of the courts of Dubai or the Rental Dispute Settlement Centre (RDSC), where applicable.


Tenant Disclosure Statement

Horizon Peak Real Estate

This Tenant Disclosure Statement is provided in accordance with the regulations of the Dubai Land Department (DLD) and the Real Estate Regulatory Agency (RERA). It is intended to inform prospective tenants of their rights, responsibilities, and the role of Horizon Peak Real Estate in rental transactions.


1. Role of the Brokerage

Horizon Peak Real Estate is a RERA-licensed real estate brokerage acting solely as an intermediary between the landlord and tenant.
We do not own the property, nor do we act as a principal party to the tenancy agreement.


2. Property Information Disclaimer

  • All property details, including rental price, size, condition, and availability, are provided based on information supplied by the landlord or authorized parties.

  • Horizon Peak Real Estate does not guarantee the accuracy or completeness of such information.

  • Tenants are advised to inspect the property and verify all details before signing the tenancy contract.


3. Tenancy Contract & Ejari

  • The tenancy contract is a legally binding agreement between the landlord and tenant.

  • All tenancy contracts in Dubai must be registered through Ejari in compliance with DLD regulations.

  • Unless otherwise agreed in writing, the tenant is responsible for Ejari registration and related fees.

  • Horizon Peak Real Estate may assist with Ejari as a facilitation service only.


4. Brokerage Commission & Fees

  • Brokerage commission is payable by the tenant as agreed and in accordance with RERA guidelines, unless otherwise stated in writing.

  • Commission becomes due upon signing of the tenancy contract or issuance of Ejari, whichever occurs first.

  • Government fees, Ejari charges, utility deposits, and service provider fees are the responsibility of the tenant unless agreed otherwise.


5. Security Deposit

  • Security deposits are paid directly to the landlord unless otherwise agreed.

  • The tenant acknowledges that Horizon Peak Real Estate is not responsible for holding, refunding, or disputing security deposits.


6. Maintenance & Property Condition

  • Maintenance responsibilities are governed by the tenancy contract and UAE rental laws.

  • Horizon Peak Real Estate is not responsible for property maintenance, repairs, or condition after handover.


7. Rental Increases & Renewals

  • Rental renewals and any increase in rent are subject to RERA Rental Index guidelines and applicable UAE laws.

  • Horizon Peak Real Estate may provide guidance based on available data, but final terms are agreed directly between landlord and tenant.


8. Dispute Resolution

Any disputes arising from the tenancy contract, rental payments, maintenance, eviction, or Ejari matters shall be resolved between the landlord and tenant, and where applicable, referred to the Dubai Rental Dispute Settlement Centre (RDSC).


9. Limitation of Liability

Horizon Peak Real Estate shall not be liable for:

  • Landlord actions or omissions

  • Tenancy contract breaches

  • Rental payment disputes

  • Ejari processing delays beyond our control


10. Acknowledgment

By proceeding with the rental transaction, the tenant confirms that they have read, understood, and accepted this Tenant Disclosure Statement.
